Please note all Wilmslow Driving School instructors are self-employed and operate under a franchise with us. Your driving lessons are made solely between you and the instructor. All financial transactions are between you and the instructor. This includes pre-paid lessons paid directly to the instructor from either WDS or yourself directly.

 

All of our franchisees are subject to a police DBS check to ensure they have no criminal convictions before they are able to become a Wilmslow Driving School franchisee.

 

 

If you have chosen to undertake driving tuition, this agreement is between you and your WDS franchise instructor. No contractual liability shall arise or subsist between you and WDS

 

Where payments are made directly to the instructor, WDS does not accept responsibility whatsoever for any acts, default or failure on the part of the instructor not to carry out his or her obligations.

 

Cancellations for your driving lessons should be made directly with the instructor 48 hours prior to the lesson appointment; otherwise, the lesson is chargeable. 

 

Driving lessons will begin at the agreed time with you and your driving instructor. The driving instructor reserves the right to cancel and charge you for the full value of your lesson if you are more than 10 minutes late.

 

If you turn up late for your lesson its at the driving instructors full discretion if they choose to give you that time at your agreed finish time.

 

WDS has the right to refuse a driving lesson or terminate a driving lesson should the driver be under the influence of alcohol or any other substances that would contravene road safety.

 

Pupils should always look to book their driving tests after checking with their instructor first that they are available.

Your driving instructor has a duty of care and so a test can only be booked with the full consent of your driving instructor. We have the right to withdraw our service for tests without notice should the instructor consider that you are not at test ready.

 

All block booking payments are non-refundable. In exceptional circumstances and at the instructor’s discretion any refunds that are to be made should be directly with the instructor, not Learners Club Head Office. Learners Club cannot be held responsible for any payments made to the driving instructor.

 

Due to unforeseen delays such as traffic, your driving instructor may be late. If they are they should make the time up with you and give your full agreed time.

 

The following applies to all Block Bookings and promotional offers: There cannot be a break between the lessons of more than 3 weeks; otherwise the remaining lessons will be forfeited. Abuse of these offers will result in the remaining lessons being revoked without a possibility of a refund. (This does not affect your statutory rights.)

All franchisees are required to declare to Wilmslow Driving School immediately if they become aware that they are the subject of any allegations which could be interpreted as sexual harassment or inappropriate behaviour. This includes any allegations made against the franchisee when not on driving lesson duties. Failure to do so could result in the immediate termination of their franchise agreement with Wilmslow Driving School. If a complaint should be made we will investigate their complaint and request the provision of any supporting evidence that substantiates their allegations. Wilmslow Driving School, dependent on the evidence received, may be able to take direct action at this point in time and the relevant authorities will be informed. And note we will cooperate with the relevant authorities in their investigation.

 

Refunds

 

For driving lessons purchased through your instructor, it is important to note that as all our driving instructors are self-employed franchisees, any payments made directly to them will have been retained by them personally and not transferred to Wilmslow Driving School.

While we cannot accept any responsibility for any payments you make directly to your instructor, we will do our utmost to assist you as required. As a first port of call, you should contact your driving instructor directly with your refund request, as they should be able to personally refund you.

If your instructor does not return your contact for any reason, or if a dispute or delay arises, please do let the Wilmslow Driving School Customer Services Team know. We will aim to contact your instructor to request that they either arrange a refund as soon as possible or provide you with the reasoning as to why they feel a refund is not due.

If this does not resolve the issue, please get back in contact with the Wilmslow Driving School Customer Services Team and we will look to escalate your refund request at the earliest opportunity.
